Terms and Conditions
1. DEFINITIONS
"You" - the person who buys or agrees to buy the goods from Olympus Technologies Ltd.
"Olympus" / "Us" / "We" - Olympus Technologies Limited of Melbourne Works, 8 Firth Street, Huddersfield, HD1 3BA, UK (Registered No. 2134805 England).
"Conditions" - the terms and conditions of sale as set out in this document and any special terms and conditions agreed in writing by Olympus Technologies Ltd.
"Goods" - the articles which you agree to buy from Olympus Technologies Ltd.
"Price" - the price for the Goods and Delivery, excluding VAT.
"Online Shop" - the website shop.olympustechnologies.co.uk.
"Shopping Cart" - the web page which is displayed when you click “View Cart” from any page within the Online Shop.
"Delivery Method" - a drop down list in the Shopping Cart by which you select the region to which the goods are to be delivered and therefore the delivery cost.
"PayPal" - PayPal (Europe) Ltd. – the online payment processor used to securely process your payment.
2. CONDITIONS
2.1 - These Conditions shall form the basis of the contract between you and Olympus in relation to the sale of Goods, to the exclusion of all other terms and conditions including your standard conditions of purchase or any other conditions which you may purport to apply under any purchase order or confirmation of order or any other document.
2.2 - All orders for Goods shall be deemed to be an offer by you to purchase Goods from us pursuant to these Conditions.
2.3 - Acceptance of delivery of the Goods shall be deemed to be conclusive evidence of your acceptance of these Conditions.
2.4 - These Conditions may not be varied except by the written agreement of a director of Olympus.
2.5 - These Conditions represent the whole of the agreement between you and Olympus. They supersede any other conditions previously issued.
3. PRICE
3.1 - The Price and VAT shall be as quoted in your Shopping Cart on the Online Shop, after you have selected the Delivery Method relevant to your required delivery address.
3.2 - The amount charged for delivery depends on the weight of the Goods and the delivery address. There is no delivery charge for orders above £500, excluding VAT.
3.3 - All prices are quoted in UK £ sterling. We are not responsible for any exchange rates or charges applied by PayPal or your credit / debit card company if you choose to pay using another currency.
3.4 - The Price is only applicable to orders placed through the Online Shop.
4. ORDER ACKNOWLEDGEMENT
4.1 - When you have placed your order, you will receive an automated e-mail from us to acknowledge your order and an e-mail from PayPal to confirm receipt of your payment. These e-mails do not constitute an agreement by us to supply the Goods.
4.2 - We shall send you a second e-mail to confirm that we will supply the Goods to you. You should contact us if you have not received this e-mail within 2 working days of your order.
4.3 - If we cannot fulfil your order, we shall contact you by e-mail or telephone to explain why. Your order will be cancelled and your payment refunded unless we reach an agreement with you to process an alternative order.
5. PAYMENT
5.1 - Payment of the full Price and VAT shall be made at the time of order, using PayPal. You can pay by credit card, debit card, PayPal account or any other method accepted by PayPal.
5.2 - We believe that PayPal offers a secure and trustworthy facility for making online transactions. We shall not be held liable for any fraudulent or unauthorised use or access of your payment details.
5.3 - The Goods shall not be despatched until we have confirmation that your payment has been received by PayPal.
5.4 - If you do not wish to pay using PayPal, you may contact us to arrange an alternative payment method. The Price may vary from that shown on the Online Shop.
6. DELIVERY
6.1 - Delivery of the Goods shall be made to the delivery address specified in your order. We cannot guarantee a date or time for delivery.
6.2 - We shall not deliver to addresses outside the United Kingdom or Republic of Ireland. If you place an order with a delivery address outside these areas, we shall cancel your order and refund your payment.
6.3 - We shall only despatch the Goods when all parts of the agreed order are available. This will normally be within five working days of your order but we do not guarantee any specific timescale.
6.4 - If you require the Goods to be despatched within five working days, you should telephone us on 01484 514513 during our office hours (8:30am-5:00pm Monday to Thursday, 8:30am-4:00pm Friday), before placing your order and we will tell you whether it is possible.
6.5 - If you fail to take delivery of the Goods when they arrive, we shall be entitled to charge you the resulting cost for the Goods to be redelivered to you or returned to us.
6.6 - We shall not be liable to you for any loss or damage which arises directly or indirectly from a failed attempt to deliver the Goods.
7. LOSS OR DAMAGE TO GOODS DELIVERED
7.1 - If the Goods are damaged or parts are missing when the Goods are delivered to you, you shall notify us within 48 hours by e-mail to websales@olympustechnologies.co.uk.
7.2 - If possible, your e-mail should include photographs of the damaged or incomplete Goods.
7.3 - You shall not use the damaged or incomplete Goods or attempt any repair, unless instructed to do so by us.
7.4 - The damaged or incomplete Goods shall be stored in a safe and secure location to protect them from further loss or damage.
7.5 - We shall contact you to arrange the repair or replacement of the Goods.
8. ORDER CANCELLATION
8.1 - You have the right to cancel your order at any time up to seven days after the Goods have been delivered to you.
8.2 - To cancel your order, you should telephone us on 01484 514513 during our office hours (8:30am-5:00pm Monday to Thursday, 8:30am-4:00pm Friday). You shall also notify us of your cancellation by e-mail to websales@olympustechnologies.co.uk, fax (01484 435027) or letter to Olympus Technologies Ltd, Melbourne Works, 8 Firth Street, Huddersfield, HD1 3BA.
8.3 - If you cancel your order before it has been despatched, we shall issue a refund for the full Price and VAT.
8.4 - If you cancel your order after it has been despatched, we shall arrange to collect the Goods from you. You shall hold the Goods for us in an ‘as new’ condition until they are collected. You shall package the goods in the same way as they were packaged when you received them. The cost to us of collecting the Goods and returning them to our premises shall be deducted from your refund.
8.5 - We shall issue a refund for returned Goods after they have been received back at Olympus and inspected by us.
8.6 - If we find that the returned Goods are not in an ‘as new’ condition, you will be offered a partial refund, based on the condition of the Goods. Alternatively, we can return the Goods to you, for which a further delivery charge would be made.
8.7 - Refunds shall be made through PayPal.
9. WARRANTIES
9.1 - All Goods are covered by a 12 month warranty, unless stated otherwise in the product description on the Online Shop.
9.2 - The warranty excludes consumables and wear parts (e.g. contact tips, gas nozzles, gas diffusers, torch liners and wire feed rollers).
9.3 - If Goods fail to function correctly during their warranty period, you should notify us (e-mail websales@olympustechnologies.co.uk, tel. 01484 514513) as soon as possible and we will arrange the repair or replacement of the Goods.
9.4 - If the failure is found to be a result of improper use of the Goods, you will be liable for all costs associated with your warranty claim.
